A plea bargain is when a defendant pleads guilty to receive a lesser charge instead of pleading not guilty and trying the case in front of a jury. Plea bargaining has huge advantages and sometimes it has disadvantages, however both prosecuters and defense attornies use plea bargaining to their benefit. If a defendent did not have the option to plea bargian, then he would be forced to take his case to court. This would cost billions of dollars a year! Court costs and jusry costs, defense attorney costs, when the defendent can not afford his own, will all be charged to the state. I don’t have a source or anything, but my teacher told me in our Law and Ethics class that something like 97% of cases or plead out. That is a lot!
